Acceptance of Terms

By accessing or using Gotique (the "Service"), you agree to be bound by these Terms & Conditions. If you do not agree, do not use the Service.

1. Service Description

Gotique provides AI-powered antique analysis services. You upload images of items, and our AI generates analysis reports including estimated values, authenticity assessments, and historical context. The Service is for informational purposes only and does not constitute a certified appraisal, insurance valuation, or guarantee of authenticity.

2. AI Analysis Disclaimer

Analyses are generated by artificial intelligence and are estimates only. They are not certified appraisals and should not be relied upon for insurance, legal, or financial decisions. For items estimated at $2,000 USD or above, we strongly recommend obtaining a professional in-person appraisal. Gotique assumes no liability for decisions made based on AI-generated analyses.

3. User Accounts

You must register an account to use the Service. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You must provide accurate information and promptly update it if it changes.

4. Subscriptions & Payments

Paid features are available via subscription (monthly or annual) and session packs. Session packs are available to all registered users and have a 12-month expiry from the date of purchase. Payments are processed by Stripe. Subscriptions renew automatically unless cancelled. No refunds are issued for used sessions. Subscription session credits do not roll over between billing periods.

5. Intellectual Property

You retain ownership of images you upload. By uploading, you grant Gotique a limited license to process them for analysis purposes. AI-generated reports are provided for your personal use. The Gotique name, logo, and platform design are our intellectual property.

6. Prohibited Uses

You agree not to: use the Service for illegal purposes; submit content you don't have rights to; manipulate reports for fraud; use automated tools or bots; reverse-engineer the Service; share account credentials; create multiple accounts to circumvent limits; misrepresent AI reports as certified appraisals; or submit defamatory or infringing content.

7. Privacy & Data

Your use of the Service is governed by our Privacy Policy, incorporated into these Terms by reference. User data is stored in geographic regions based on your account settings in compliance with applicable data protection laws. You may request deletion of your data at any time via account settings or by contacting support@gotique.ai.

8. Third-Party Services

The Service integrates with third-party services including but not limited to Amazon AWS, Google, Anthropic, and Stripe. Your use of these services is subject to their respective terms and privacy policies. Gotique is not responsible for the practices of third-party services.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. Gotique does not warrant that the Service will be uninterrupted, error-free, or that defects will be corrected.

10. Limitation of Liability

To the maximum extent permitted by law, Gotique shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to reliance on AI-generated analyses, loss of data, or interruption of service.

11. Indemnification

You agree to indemnify, defend, and hold harmless Gotique, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising from your use of the Service, violation of these Terms, your content, or any decision made in reliance on a report.

12. Termination

You may terminate your account at any time through account settings. Termination does not entitle you to a refund of any prepaid fees. We reserve the right to suspend or terminate your account if you violate these Terms or engage in fraudulent activity.

13. Governing Law

These terms are governed by the laws of the State of Delaware, USA. For users in China, disputes may be submitted to CIETAC (China International Economic and Trade Arbitration Commission) per our arbitration agreement.

14. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email and in-app notification before taking effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.
